General Conditions of Sale – www.marcafe.it

Art. 1 – Definitions

1.1. “Site”: www.marcafe.it, dedicated to the sale of Torrefazione Adriatica SpA products
1.2. “Customer”: the natural person (consumer) or legal entity who purchases on the Site by accepting these conditions.
1.3. “Order”: the purchase request sent by the Customer via the Site.
1.4. “Products”: the goods offered for sale on the Site.
1.5. “Price”: the price due for the Products, including VAT. Shipping costs are specified at checkout.
1.6. “Contract”: the distance contract relating to the sale of the Products between Torrefazione Adriatica SpA and the Customer.

Art. 2 – Object and conclusion of the contract

2.1. Online sales are reserved for shipments exclusively on Italian territory.
2.2. The Contract is deemed concluded when the Customer receives the order confirmation via email.
2.3. Product prices, availability, and features may change without notice; the information on the Site at the time of the Order will prevail.
2.4. The Company reserves the right to refuse abnormal or incomplete orders; in such cases, any amounts already paid will be refunded.

Art. 3 – Prices and payment methods

3.1. All prices are expressed in Euros and include VAT.
3.2. Shipping costs are indicated during the Order process.
3.3. Accepted payment methods:

• Credit/Debit Cards (Visa, Mastercard, etc.)
• PayPal
• Advance bank transfer (if applicable).

Art. 4 – Delivery times and methods

4.1. Deliveries are made via express courier to the address indicated by the Customer.
4.2. Indicative delivery times: 2/3 working days from receipt of the Order.
4.3. In the event of unavailability of one or more Products, the Company may ship only the available Products. Partial delivery is considered valid and does not give rise to the right to refusal or compensation.
4.4. Pursuant to art. 63 of the Consumer Code, the risk of loss or damage to the Products is transferred to the Customer only when the latter physically takes possession of the goods.

Art. 5 – Customer Obligations

5.1. To purchase on the Site, the Customer must register by providing truthful, correct, and complete information.
5.2. The Customer undertakes to pay the Price of the Products ordered and to keep a copy of the order confirmation received via email.

Art. 6 – Right of withdrawal

6.1. Pursuant to art. 52 et seq. of the Legislative Decree 206/2005 (Consumer Code), the Consumer Customer has the right to withdraw from the Contract within 14 days from delivery of the Products.
6.2. The right of withdrawal applies exclusively to consumers (natural persons purchasing for non-professional purposes). Companies and retailers are excluded.
6.3. To exercise the right of withdrawal, the Customer must send written communication to info@marcafe.it within 14 days of delivery.
6.4. Products must be returned intact, unopened, and with their original labels. Returns of opened or used food products will not be accepted.
6.5. Return costs are borne by the Customer.
6.6. The Products must be sent to:

6.7. The refund will be made within 14 days of receipt of the returned goods, after checking the condition of the Products.
6.8. The right of withdrawal does not apply to:

• Customized products
• Discounted/outlet products
• Open food products

Art. 7 – Legal guarantee of conformity

7.1. All Products sold are covered by legal guarantee of conformity of 24 months, as provided for by articles 128-135 of the Consumer Code.
7.2. In case of defects, the Customer must communicate it promptly via email to info@marcafe.it, attaching proof of purchase and a description of the problem.

Art. 8 – Force majeure

8.1. Neither Party shall be liable for delays or failures to perform due to force majeure (strikes, natural events, computer failures, etc.).

Art. 9 – Intellectual property

9.1. Brands, logos, and distinctive signs present on the Site belong to their respective owners.
9.2. Unauthorized reproduction or use of the Site's contents (texts, images, graphics, etc.) is prohibited.

Art. 10 – Privacy

10.1. The Customer's personal data are processed in compliance with the EU Regulation 2016/679 (GDPR) and current Italian legislation.

Art. 11 – Communications

11.1. Any communication may be sent via email to info@marcafe.it or by registered mail with return receipt to the Company's address.

Art. 12 – Applicable law and competent court

12.1. These conditions are governed by Italian law.
12.2. In the event of a dispute, if the Customer is a consumer, the competent court is the Customer's place of residence or domicile, pursuant to art. 66-bis of the Consumer Code.
12.3. Otherwise, for non-consumer customers, the exclusive jurisdiction is that of Teramo.
