General Terms and Conditions of Sale - www.marcafe.it

Article 1 - Definitions.

1.1. "Site": www.marcafe.it, dedicated to the sale of the products of Torrefazione Adriatica S.p.A.
1.2. "Customer": the natural person (consumer) or legal entity that buys on the Site accepting these conditions.
1.3. "Order": the purchase request sent by the Customer through the Site.
1.4. "Products": the goods offered for sale on the Site.
1.5. "Price": the consideration due for the Products, including VAT. Shipping charges are specified at checkout.
1.6. "Contract": the distance contract relating to the sale of the Products between Torrefazione Adriatica S.p.A. and the Customer.

Article 2 - Subject matter and conclusion of the contract

2.1. The online sale is reserved for shipments exclusively within the territory of Italy.
2.2. The Contract is considered concluded when the Customer receives the order confirmation by email.
2.3. Prices, availability and characteristics of the Products may vary without prior notice; the information on the Site at the time of the Order shall prevail.
2.4. The Company reserves the right to reject abnormal or incomplete orders; in such case any sums already paid will be refunded.

Art. 3 - Prices and terms of payment

3.1. All Prices are in Euros and include VAT.
3.2. Shipping charges are indicated during the Order process.
3.3. Accepted methods of payment:

  • Credit/Debit Cards (Visa, Mastercard, etc.).
  • PayPal
  • Advance bank transfer (if applicable).

Art. 4 - Timing and delivery methods.

4.1. Deliveries are made by express courier to the address indicated by the Customer.
4.2. Indicative delivery time: 2/3 working days from receipt of the Order.
4.3. In case of unavailability of one or more Products, the Company may ship only the available Products. Partial delivery shall be deemed valid and shall not entitle the Company to rejection or compensation.
4.4. Pursuant to Article 63 of the Consumer Code, the risk of loss of or damage to the Products is transferred to the Customer only at the moment when the latter materially takes possession of the goods.

Article 5 - Obligations of the Client

5.1. To purchase on the Site, the Customer must register by providing true, correct and complete data.
5.2. The Customer agrees to pay the Price of the ordered Products and to keep a copy of the order confirmation received by email.

Art. 6 - Right of withdrawal

6.1. Pursuant to Article 52 et seq. of Legislative Decree 206/2005 (Consumer Code), the Consumer Customer has the right to withdraw from the Contract within 14 days after delivery of the Products.
6.2. The right of withdrawal applies only to consumers (individuals purchasing for non-business purposes). Companies and retailers are excluded.
6.3. To exercise the right of withdrawal, the Customer must send written notice to. info@marcafe.it within 14 days of delivery.
6.4. Products must be returned undamaged, unopened and with original labels. Returns of already opened or used Food Products will not be accepted.
6.5. Return costs are the responsibility of the Customer.
6.6. The Products must be sent to:

6.7. Refunds will be made within 14 days of receipt of the returned goods, subject to verification of the condition of the Products.
6.8. Are excluded from the right of withdrawal:

  • Customized products
  • Discounted/outlet products
  • Open food products

Article 7 - Legal guarantee of conformity

7.1. All Products sold are covered by a 24-month legal warranty of conformity, as provided for in Articles 128-135 of the Consumer Code.
7.2. In case of defects, the Customer shall promptly notify info@marcafe.it by email , attaching proof of purchase and description of the problem.

Art. 8 - Force Majeure

8.1. Neither Party shall be liable for delays or non-performance due to force majeure (strikes, natural events, computer failures, etc.).

Art. 9 - Intellectual Property

9.1. Trademarks, logos and distinctive signs on the Site belong to their respective owners.
9.2. Unauthorized reproduction or use of the contents of the Site (text, images, graphics, etc.) is prohibited.

Art. 10 - Privacy

10.1. Customer's personal data are processed in compliance with the EU Regulation 2016/679 (GDPR) and applicable Italian law.

Art. 11 - Communications

11.1. Any communication may be sent by email to info@marcafe.it or by registered A/R mail to the address of the Company.

Article 12 - Applicable law and place of jurisdiction

12.1. These conditions are governed by Italian law.
12.2. In the event of a dispute, if the Customer is a consumer, the competent court is that of the Customer's residence or domicile, pursuant to Article 66-bis of the Consumer Code.
12.3. Otherwise, for non-consumer customers, the exclusive jurisdiction is that of Teramo.
